Thailand is intensifying its efforts to cement its position as a regional financial hub by accelerating the development of a regulatory framework for crypto index products. Through two public consultations launched in late August, the local securities regulator is refining the conditions for listing BTC and ETH index ETFs. This initiative is part of a multi-year strategic plan aimed at further integrating digital assets into the traditional financial ecosystem while ensuring rigorous oversight of the involved players.
Current proposals impose strict safeguards to ensure the robustness of these future investment vehicles. Asset managers will be required to maintain a minimum exposure of 80% of their net assets to the underlying cryptocurrency throughout the accounting year. To maintain optimal control, these financial instruments will be exclusively tradable on the Stock Exchange of Thailand (SET). This initial phase is limited to the two market leaders, BTC and ETH, as the regulator deems other digital assets to still have insufficient liquidity and maturity for a direct public listing.
The crucial issue of asset custody remains the primary point of friction in this legislative process. Following mixed feedback during an initial consultation phase in the spring, the regulator has adopted a pragmatic approach: local custodians remain the standard, but flexibility is introduced to authorize, under certain conditions, highly qualified international providers. This compromise demonstrates the desire to protect the domestic industry while gradually opening up to the global expertise essential for attracting institutional investors.
The regulatory timeline is now set, with the public consultations scheduled to close on September 20. This legislative initiative, which comes in addition to the recent recognition of cryptocurrencies as underlying assets for futures contracts, marks a significant step up for the country. While an initial BTC ETF experiment reserved for high-net-worth investors has already been launched, the current project aims to democratize access to digital assets for a much broader audience, confirming Bangkok's commitment to structuring a sustainable, regulated, and accessible crypto market.
